Yes, she is at fault for the issue. They load the food on at the source flight and it’s not always checked. So it should not disembark at the destination.

I could be wrong, but I have a strong suspicion that if you said “Oops, I totally forgot I had that in my bag, is there somewhere where I can throw it out?”, there would not have been a fine. Given what I’ve seen from the woman’s comments, I’d guess she took a much more confrontational and entitled stance.

The customs and border patrol website States you can do that but the caveat is you have to have declared the item. If it is not declared then you face a civil fine or however they word it.
